'Superstitious nonsense' remark violated rights

U.S. District Judge James Selna ruled Friday in a lawsuit student Chad Farnan filed in 2007, alleging that teacher James Corbett violated the establishment clause of the First Amendment by making repeated comments in class that were hostile to Christian beliefs.

The lawsuit cited more than 20 statements made by Corbett during one day of class, which Farnan recorded, to support allegations of a broader teaching method that "favors irreligion over religion" and made Christian students feel uncomfortable.

During the course of the litigation, the judge found that most of the statements cited in the court papers did not violate the First Amendment because they did not refer directly to religion or were appropriate in the context of the classroom lecture.

But Selna ruled Friday that one comment, where Corbett referred to creationism as "religious, superstitious nonsense," did violate Farnan's constitutional rights.

Selna wrote in his ruling that he tried to balance Farnan's and Corbett's rights.

"The court's ruling today reflects the constitutionally permissible need for expansive discussion even if a given topic may be offensive to a particular religion," the judge wrote.

"The decision also reflects that there are boundaries. ... The ruling today protects Farnan, but also protects teachers like Corbett in carrying out their teaching duties."

LOL, it is better than not slowing and making sure you are not rocketing into oncoming traffic. Had a kid do that a few years ago right in front of me. He came off the ramp onto the highway at about 80mph, looked over his shoulder and slammed into the back of a semi stopped in a traffic jam. That poor bastard was wedged up under the dashboard. I had to hold his head while they cut the car out from around him. Well, both of us at that point.

Back in the Sixties some behaviorists tried to prove chimpanzee intelligence by teaching a chimp to drive. It worked just fine until they realized that, to a chimp, Green meant "Go", and Red meant "Stop", period. Said chimp would stomp the gas on green, even if there was a vehicle in the intersection in front of it- or a semi bearing down on it from the cross-street.

I strongly suspect that the methods those behaviorists used on that chimpanzee are now being used in Driver's Ed classes throughout Ohio.

Damn, that had to hurt for him. Granted I suggest entering a freeway at speed, but one must also make sure there is space to enter. I learned the Detroit method of entering a freeway.
1. Get up to speed by the end of the ramp. Not 45, not 55, be going 70+.
2. Make sure there is enough room to do so. Do not check for space at the last possible second, choose your spot before you are halfway down the ramp.
3. Merge in smoothly and adjust speed to the flow. Do not expect traffic already on the freeway to adjust for you.

2. Make sure there is enough room to do so. Do not check for space at the last possible second, choose your spot before you are halfway down the ramp.
3. Merge in smoothly and adjust speed to the flow. Do not expect traffic already on the freeway to adjust for you.

As opposed to the NYC version of merging:
Get up to the same speed as the right lane.
As soon as possible, get exactly next to someone already on the highway.
Stay matching speeds until he lets you in.

Usually, when someone in Mass. does that, they're on a cell phone.

I just got out of a ticket last week for speeding in one of my work vehicles. When the trooper came up to the car (he was very nice) he noticed I did not have my seatbelt on. He asked me if I took it off to get my registration out of the glove box. I told him no, I did not have it on, as I was exempt from the seatbelt law in a Livery vehicle. He told me that I was wrong, Livery was not exempt. I told him I would bet him the ticket, and he agreed. He came back with a sheepish grin and a written warning, and told me I could tell my friends I had taught a state trooper something today. I told him that I would NEVER, never do that, and he laughed like a loon. All in all, a good day, no $300 ticket!

I've heard about Atlanta drivers. The worst of the South and the Yankees put together. There was even a site up about them for a while, the TARD Site (The Atlanta Roadways Digest).

Hotlanta ain't got nothin' on Vegas.

And it actually wasn't that much worse than Colorado Springs, to tell the truth. We moved from New Jersey to CO Springs, and I was stunned by how rude and ignorant the CO Springs drivers were.

I've driven in Philly, Chicago, Atlanta, and lots of rural places. Worst drivers by far--Vegas and CO Springs. I blame it on all the California transplants.

Yeah, the kid barely made it. I had heard stories of people being jammed under dashboards, and have been first on scene at dozens of accidents just because of the work I do, but I thought it was an exaggeration until I saw it with my own eyes. It is NOT pretty. Be careful out there, folks, horrific things do happen every day.

In one stretch, there are Stop signs at the end of the on-ramps!

That's called energy management.

Very similar deal in Los Angeles. Say you get on the freeway on a lane that then turns into an exit-only, so you have merge, then move over one more. Always, some guy in a Tahoe will be in that #2 lane, overtaking at about 85. He will not slow down to let you merge. He will pass you, then hit the brakes, slowing to 45, preparing to exit, making it that much harder for you to merge left.

To follow your energy management solution, pulling in front of him at 85, I guess I'd need another 80 horsepower or so.

Had them do that shit occassionally here. Usually I lay hard on the horn until the dipshits move. More often than not, it's that they try to enter the freeway at 40mph just in front of me. I'm afraid I'm going to get splatted by a truck because some asshole entered the freeway at 40 or below just in front of me.

That stretch of Rt. 2 had been built as an old-type highway, maybe a fence down the middle, with intersections. There is even a stoplight (now permanently flashing yellow) at one point.
They've partially improved it.
The worst part, though, is the stretch through Concord, which does have a 45 limit, and traffic lights every mile or so. I've heard Concord fights any attempt to upgrade it, they don't want the traffic. They get the traffic anyway, because that's the only way into Boston without going 30 miles out of the way.
The road is so bad the commuter rail line is packed.

My dad used to scratch his head and mutter bad things about the engineering geniuses who came up with that design.

That stretch of Rt. 2 had been built as an old-type highway, maybe a fence down the middle, with intersections. There is even a stoplight (now permanently flashing yellow) at one point.
They've partially improved it.
The worst part, though, is the stretch through Concord, which does have a 45 limit, and traffic lights every mile or so. I've heard Concord fights any attempt to upgrade it, they don't want the traffic. They get the traffic anyway, because that's the only way into Boston without going 30 miles out of the way.
The road is so bad the commuter rail line is packed.

See, I lucked out. I got to drive in Southern Indiana on a road that curved gently through rolling hills and at one point went through a grove of trees that met overhead and created this wonderful tunnel through the grove that was just amazing--almost sacred.

Until they chopped all those trees down to widen the road to four lanes. Now it's gone.

Around Chicago some of the freeway interchanges, especially on the Edens Expressway, have intermingled cloverleaf interchanges where the on ramps cross with the exit ramps. Makes for some interesting situations where you have cars trying to accelerate to 60mph intermixed with cars trying to deaccelerate from 60 mph. My dad used to scratch his head and mutter bad things about the engineering geniuses who came up with that design.

I-55 has a few of those out my way as well. Have to put up with the slow down at Lemont Road every morning. Also, the idiots that get off to go onto I-355 north always back up onto northbound I-55, causing a backup from 53. Why is this? Because the ramp splits into two lanes for a short distance then contracts back to one lane. Of course, being Chicago drivers, they use the other lane then try to bull their way back in.

Outbound is just as bad with the woefully underpowered exit ramps at 53, Weber, and 30. They all back up from the traffic light at the end of the ramp onto the freeway. I hate IDiOT.

I was driving home Friday after work, North on the 15 freeway, right by Miramar. Traffic is alway clogged right there. The car next to me was an older kinda dented little white car with a......very large......woman in it. She was smoking what looked like a cigarette, but not really. I cracked my window down on the passenger side and, sho 'nuff, she was toking on the biggest joint I've ever seen. As soon as I could I maneuvered as far away from her as I could.

A little off topic but here in California people refer to freeways very formally. They call it The 405....or The 91. I still think that's a little strange and think that the freeways have done nothing to earn that kind of respect.
The other thing I dislike here is how they refer to streets as surface streets. I always ask myself...are there any other kind. Are there like.....subsurface streets?

Sounds like fun. A few years ago, IDOT decided to fix what was then known as the Hillside Strangler. A freeway and a tollway merged together there (I-290 EB and I-88 EB) along with ramps from Roosevelt Rd (IL-38) and the Tri-State Twy (I-294). Traffic would backup something fierce there everyday, even on weekends. Well, IDOT, in their infinte wisdom, decided not to add lanes, but to move the merge point eastward, away from the Tri-State. It still backs up, but it backs up one suburb to the east.

Couple of weeks back, I was headed out to a meeting after work. The route takes me through a little commute traffic, although not bad. It was a gorgeous day, so I had the windows down in the minivan. As a huge electrical service bucket truck passed me slowly, I smelled a familiar smell. The passenger was toking right at the window in traffic at 5mph at 6:00 pm (broad daylight). It has to be a worry. Iran has blustered and threatened Israels very right to exist, in short, declared war and, thereby, made itself a legitimate target if it goes nuclear. By Pakistan? If the Taliban get to take over what are the options open to Israel then? It is not rocket science to assume that there would quickly follow some sort of pact between Iran and a Taliban-controlled Pakistan with a free exchange of "ideas" (ie read "hardware")

Even more considering that despite some reactions to vaccines, the net effect is a negative number of people killed - they save millions or billions of lives.

A little off topic but here in California people refer to freeways very formally. They call it The 405....or The 91. I still think that's a little strange and think that the freeways have done nothing to earn that kind of respect.
The other thing I dislike here is how they refer to streets as surface streets. I always ask myself...are there any other kind. Are there like.....subsurface streets?

I was driving home Friday after work, North on the 15 freeway, right by Miramar. Traffic is alway clogged right there. The car next to me was an older kinda dented little white car with a......very large......woman in it. She was smoking what looked like a cigarette, but not really. I cracked my window down on the passenger side and, sho 'nuff, she was toking on the biggest joint I've ever seen. As soon as I could I maneuvered as far away from her as I could.

I was driving from Texarkana to Little Rock a few years ago and passed a woman who was driving with a paperback book propped against the steering wheel.

I was trying to differentiate it from the state route 128.

Fortunately, I only go one exit on 128, unless Rt. 3 is backed up and I have to take Rt. 2 instead.

The freeways have names up here in Norcal -- Nimitz (I-880), MacArthur (I-580), Bayshore (US 101), etc -- but no one ever uses them.

They were signed and funded differently. The US routes date from 1926, and the Interstates from 1956. This is an excellent site about the US routes.

I've come to the conclusion that we're stuck with fighting the Persian wars all over again.

The "progressives" are mystics, who want everything to be decided on "feelings". They are anti-science, anti-technology, and the only difference between them and the IDiots is that they prefer to worship Gaia. Which is another way of saying "earth and water". They are determined to rule, and don't really care who gets hurt in the process, because they think there are too d***ed many people "oppressing" their "goddess" already.

And they will support any loony belief, as long as it is opposed to Western, linear, rational thought. Which probably explains their infatuation with people who hate us, like the Islamists. It's nothing personal, they're just operating on the principle of "we hate the same things". Like actually thinking, instead of "emoting". They have their dogmas, so they don't need to reason- in fact, they resent the implication that reason is superior to just "doing what feels good".

The battles of Marathon, Thermopylae, and Plataea in the 5th century B.C. were fought over these exact issues. Mysticism vs. rationalism. Democracy vs. "Do as your betters tell you, or else".

I find myself wondering how Leonidas, Miltiades, Pausanias, or Aristides would react to learning that the civilization they fought (and in Leonidas' case, died) to protect had produced a crop of "intellectuals" and "celebrities" who basically sympathized with the likes of Darius and Xerxes.

Not a good idea. We had a lady up north in Lake County just plow into a motorcylist stopped for a red light, killing her. The motorcylist even had her helmet on. The car driver was busy painting her nails when the plowed into the motorcylist. She has been arrested and is now facing charges.

The women drive 25 mph, the men are aggressive as hell and put Nascar drivers to shame.

Snowbird season is September through April... those are the months that we buckle up, say three Hail Mary's and pray like hell we make it to our destination.
