The other shoe just dropped for Chuck C. Johnson (who is NOT ME) and his lawyer John Burns; the judge has thrown out Chuck’s entire 111-page opposition to Gawker’s motions and all 800+ pages of exhibits, with a scathing ruling you can read below.

Chuck and his crack legal staff are still being given one more chance to do it right; they have until this Thursday to file an opposition that actually follows the rules.

That’s most likely it. As I mentioned downstairs, the one thing judges don’t like is being overturned on appeal. Striking a combined opposition and then ruling as if there was no opposition probably wouldn’t sit well with the Circuit Court.

For a fast fix, you did good. Tamarind sauce (pad thai sauce base) plus curry ingredients equals a dish that somebody probably serves in Burma or NE India.

My boss is on one of those meal plans where everything is calorie/carb controlled and delivered to him. I pity him. the meals look terribad most of the time.

We’ve been giving this one a trial run, because I had been stuck on a plateau and really, really irritated about it, and a friend recommended it.

Reasonably happy with it (and NUMBERS MOVED). I won’t claim the food is 5-star quality, but it’s reasonable enough (spices are free, after all, and can be added at home…) - better than your average frozen food from the grocery store. And they’re filling - I don’t find myself wanting extras even though I’m only eating ~1200 calories in a day on the plan. So they get points for that.

It’s not cheap though, and our meal delivery ends up coming on Saturday (ugh) so I’m looking at whether we can get a shipment for 8 days at a time and then do it 4 days a week. That’d still let me cook and give us time to go out, without getting too off track. It’s not a long-term plan, but it’s made me happy enough that I want to investigate that, so.

Good luck to you. Weight loss can be a hard thing to manage. I’m actually stuck at a bit of a plateau right now, but it’s really close to my target weight anyway, so I’m actually not too bothered about trying to do more about it.

Probably hovering in the 1600-2000 range, but I have not been seriously counting. It drives me up a wall and I can’t sustain it long term.

When I cook, I tend to aim for recipes in the 600 calorie for a meal range.

If you were losing for a while and hit a plateau at that level of calories then your metabolism may have slowed down. I was losing 10+ lbs a month the first few months then hit a similar plateau, had to increase my calories and then weight started coming off again.

You might want to try My Fitness Pal for android/iphone/web. They have a great food database, you can add in your recipes and it will total the calories and everything is at your finger tips for counting totals and maintaining sanity. I still use it and am trying to reverse diet to maintenance/bulking levels.

I’ve used similar stuff in the past. Part of it is just a desire for complete hands-off required on my part right now, because there’s a bunch of other things I’ve got responsibility for and it’s a lot of work (as I’m sure you know) to plan healthy meals.

This is, I fully admit, the really lazy way to do it, and as long as the food remains tolerable with occasional forays into good and the weight keeps coming off, I will probably stick with it for a while. :)

I recalibrated a lot of my estimates when I worked on losing weight for the wedding (which I did, successfully) and still have some of the habits from then built in.

Dinner really is the bulk of the work. I have a set of standards that I rotate through but I’m always trying new things too. But we’re talking about moving in the next year, and I have a pile of things that need the attention, and I do all the planning/shopping/cooking. Something had to give.

I have successfully made the switch to diet sodas over the past 8 years, and getting the fridge has me drinking a lot more ice water. (It has to be ice cold.)

I track my empty calories fairly closely, these days, and have cut them back quite a bit. And on the exercise front, I am in fantastically better shape than I was back in July and continue to work on that. But the scale was not cooperating (some of which was definitely building muscle, I know).

I drink coffee in the morning, rest of the day it’s mostly water.
I’ve lost 25 pounds so far. I need to walk/hike more.

I was plateaued over the summer mainly due to building muscle (while still losing some fat) then cut drastically along with HIIT cardio to get the last 10lbs I wanted to lose off. This is exhibit A of what’s wrong with the profession and how bad lawyers get to stick around and give everyone else a bad name.

These motions and filings by Chucky’s legal “team” are a waste of everyone’s time - especially the court’s time. Considering that the courts are overburdened with too many cases and too few judges since the federal bench is still short of filling all the positions, allowing this case to continue to soil the docket is a mistake IMO.

That the order included a paint by numbers approach to file according to the rules says it all. If you need the court to tell you how to file your motions in papers, that’s a sign you’re not meant to practice law.

And that doesn’t even begin to address the substantive problems the Court found with Chucky’s filing - like improper numbering, copypasta, etc.

Yet, the Court’s willing to give him yet another chance to get this filing together.

I can hardly wait to see the baffling BS his team tries next.

I think the Judge may be setting Chuck up for an epic anti-SLAPP ruling and really doesn’t want to be reversed on appeal because he threw out all of Burns’ motion on procedure alone. At the same time he’s pissed off and wants Burns to run another lap, if for no other reason than Burns already complained of exhaustion. If the Judge just wanted to get rid of the case he could have simply seized on the agreement to move the case to California and washed his hands of the whole thing.

Financially-troubled plans are plans expected to not have enough money to pay 100% of benefits within 15 and, in some cases, 20 years.1 There are instances where the cuts could be more than 60% of a participant’s benefits. To find out how much your benefits could be cut use this calculator.

The decision to cut benefits is made by plan trustees, who are typically more aligned with active workers and employers than with retirees.

Retirees who are age 80 or over, or who are receiving a disability pension, are not subject to benefit cuts. Retirees ages 75-79 are subject to smaller cuts than retirees under age 75.

How big or small the cuts are for those under age 75 is determined by the trustees. The cuts are subject to certain legal limits, the most important of which is that benefits cannot be cut below 110% of the amounts that the federal pension insurance agency guarantees.2

Plan trustees decide how to allocate the cuts. For example, they can cut retirees’ benefits more than those of active workers, and they can decide whether and how much to reduce survivors’ benefits.

Plan trustees are required to reduce the benefits of participants whose employers went out of business (or withdrew from the plan for other reasons without paying all of their obligations) first, before they reduce the benefits of any other plan participants. This will mean that those retirees whose companies went bankrupt will have greater reductions than other retirees.

It may not amount to much, but maybe some of the love Webb got in the debate was from the conservatives that watched it. Maybe he really takes nothing away from the Democrats and actually costs some Republican votes.

CBS is refusing ads because there’s now serious bad blood between the CBS execs and Dan Rather. Rather brought shame on them, then refused to take personal responsibility for screwing up, and instead turned around and sued CBS.

But CBS themselves also bears some responsibility for letting Rather avoid his own responsibility, because their so-called “investigation” stopped short of admitting outright the documents were frauds, even though they HAD to know it by that point.

Frankly, all these people are weasels. All of them.

Most countries don’t have regularly scheduled elections where you could stretch out the calendar this way.

I’ve tended to think that this schedule made our system stable, because you could plan even when a change in leadership was going to occur. But that’s failed in the super-partisanship that we’ve evolved into and having the Tea Party stopping the function of government. Now, I think we really should have elections where, if you win, you get control of government to implement your plans. If they suck bad enough, you’ll get thrown out.

I confess I’ve never watched Downton Abbey. But it’s on my Netflix list, so one of these days.

It’s surprisingly addictive. I got hooked after three episodes. If you ever watched Upstairs, Downstairs, it has some similarities to it. The acting in Downton is really good (Maggie Smith steals every scene she’s in) and the plots and subplots are fairly believable, if somewhat predictable.

Aristocrats’ daughter marries chauffeur, another daughter has child out of wedlock, eldest daughter loses love of her life in a car wreck)

They manage to work in historical events to ground the events in some kind of reality. Neville Chamberlain paid Downton Abbey a visit just the other night! [Before he was PM]

The background is the social change affecting the aristocracy and landed gentry from 1910 on, which also affects the people they employ — the servants.

Oh, definitely. There’s even some hint of that among the servants, and the chauffeur-turned-gentleman also has some unionist leanings.

Everyone’s role back then was tightly constricted (like the ladies in their corsets). The upper class had to act just in this way, and the servants were destined to always be servants. In DA, though, you see where those strict lines of demarcation are beginning to blur, with the Downton daughters doing real work and servants getting middle class office jobs.

Chuck lost sight of the Hollywood motto, “The only bad publicity is no publicity.” All this fuss and bluster about floor shitting and sheep fucking has just perpetuated the rumors forevermore. In fact, Gawker’s articles concluded that Chuck had neither pooped on the floor or violated a ewe, and any reader with a modicum of intelligence would realize those events never happened. They were rumors started by people who knew him in college.

Apparently, Mulcair refinanced his house 12 times (hubby said it was confirmed). Very unCanadian. That could hurt.

I’m unsure why that is a bad thing. The way interest rates have been falling if I owned a house and if I could I’d have refinanced too.

It’s surprisingly addictive. I got hooked after three episodes. If you ever watched Upstairs, Downstairs, it has some similarities to it. The acting in Downton is really good (Maggie Smith steals every scene she’s in) and the plots and subplots are fairly believable, if somewhat predictable.

I admit, I do not check all the workings of all the major polls and all the newer polling methods and if those traditional polls rely on things like the internet. I usually go by the RealClearPolitics poll averages or the biggest polls. The one I saw today was NBC/WSJ.

My bottom line. I don’t trust too many polls especially this early. For the primaries, the actual voting is my polling. When we get to the general election in November ‘16, the polls in late September early October seem to be clearer. Outside that, it’s all suspect to me.

Look at it this way: he has NO chance in Iowa, and next to no chance in South Carolina. That means he has to WIN New Hampshire. If he goes 0 for 3, the party establishment will (reluctantly) pull together around a different anti-Trump.

Reading the judges ruling on CCJ’s/Burns filings, I’m struck by the sarcasm underneath. The judge’s response contained not only a primer on how to actually file with the court, but also provided a clear example of how to argue. The response to each point cited appropriate references, the overall document was concise, short and done in a short amount of time.

I suspect the judge understands that there’s no way in hell Burns and CCJ will be able to provide an adequate response, especially by Thursday. And when they don’t, there will be no excuses after all the granted delays and after being provided a cook book on what to do and how to do it.

One can only hope the judge is actually pissed and getting ready for a smack-down that can’t be appealed.

Just thoughts for debate. Right now, they do not seem to have the RNC that is powerful enough to stop him, or Carson. All the fractures in the party won’t allow for any kind of a base of power to form. There appears no strong group of even money men to push the moves, they do not know who to put the money behind at this late date.

At this time, I see no legit way for them to actually stop Trump. And as I posted above, I am already hearing conservative talking heads saying it is this close >< to being inevitable.

I suspect the judge understands that there’s no way in hell Burns and CCJ will be able to provide an adequate response, especially by Thursday. And when they don’t, there will be no excuses after all the granted delays and after being provided a cook book on what to do and how to do it.

One can only hope the judge is actually pissed and getting ready for a smack-down that can’t be appealed.

P.S. I’m not a lawyer, don’t play one on TV and seldom watch actors playing lawyers on TV.

The tone reminded of a professor not-so-patiently explaining to a procrastinating student how one prepares and submits a master’s thesis.

Well, I did watch the first season of TWD, but after that lost interest quickly.

Never watched Glee.

Heck, I never watched that popular sitcom about that bar with lots of characters people liked, back in the ‘80’s and early 90’s I think it was. “Cheers”. Never watched a full episode.

Ted Danson, who played the bartender Sam, is now a CSI geek on CSI:Cyber. Same likable personality in either role.

The Bloc Quebecois (and their provincial allies, the Parti Quebecois) want an independent Quebec and are really fervent about opposing English-language signage and so forth. They’re also quite left-wing economically, but that isn’t their biggest problem.

What I dislike the most about them is whining about needing to preserve and protect their cultural and language heritage, and then stomping all over the First Nations and Inuit cultures in their attempts to do so. Not to mention the rules regarding signage.

A lot can happen in the next 4 (!) months…but I am just not feeling those of you who seem to assume Jeb! is going to shoot like a rocket from where he is now to the nomination.

Look at it this way: he has NO chance in Iowa, and next to no chance in South Carolina. That means he has to WIN New Hampshire. If he goes 0 for 3, the party establishment will (reluctantly) pull together around a different anti-Trump.

Now, it IS possible Jeb! could pull this off…but do you REALLY think he looks and sounds like someone ready to lay it all on the line? I just don’t see it. I think he only decided to run because he thought it would be a “joyful” campaign/coronation. I honestly wonder if he might not have packed it in already if it weren’t for the ridiculous amount of money that has been raised.

I read the decision. Basically, the attorney didn’t follow the rules and is allowed to try again, but he has to follow the rules. You’ll note, nearly everything denied was denied “without prejudice” which means there’s one more chance to fix this.
