Guardian’s Story Changes Again: Now They Admit David Miranda Did Have a Lawyer

Remember the Guardian’s first reports about the UK government detaining Glenn Greenwald’s partner David Miranda, and how Greenwald said Miranda had been “denied a lawyer?”

August 18th: Glenn Greenwald’s Partner Detained at Heathrow Airport for Nine Hours.

“This is a profound attack on press freedoms and the news gathering process,” Greenwald said. “To detain my partner for a full nine hours while denying him a lawyer, and then seize large amounts of his possessions, is clearly intended to send a message of intimidation to those of us who have been reporting on the NSA and GCHQ. The actions of the UK pose a serious threat to journalists everywhere.

Then, the next day, the Guardian’s story changed. In this article they write that Miranda “refused” a lawyer because he didn’t trust the UK: David Miranda: ‘They Said I Would Be Put in Jail if I Didn’t Co-Operate’.

He was offered a lawyer and a cup of water, but he refused both because he did not trust the authorities.

Well, today the story has changed again. And now the Guardian is acknowledging that Miranda actually did have a lawyer — buried near the very end of this article: David Miranda Wins Partial Court Victory Over Data Seized by Police.

He was compelled to provide passwords for the devices. His lawyers said he only had a lawyer for the last hour of his detention and was not allowed a pen to write down the officers questions or a translator even though English was not his first language.

It’s absolutely unreal how these stories just keep changing, after starting out with the most negative slant possible. The most charitable interpretation is that the reporting has been inexcusably sloppy — but this series of revisions strongly suggests they were deliberately misleading their readers.

Greenwald in particular had to know when he made that first statement that his partner actually did have a lawyer. Why did he lie?

The most charitable interpretation possible is that the reporting has been inexcusably sloppy — but this series of revisions strongly suggests they were deliberate misleading their readers.

After the “MacBook Pro” episode, I don’t know how one could conclude that it’s not both.

I wait with bated breath.

In the meantime, I await the next set of walkbacks on the NSA story from the WSJ, Guardian, and others who ran with outrageous headlines, while the actual report was so much less.

Oh, and the outrageous outrage over Cass Sunstein getting involved in the oversight. Really? That’s outrageous?

Would not surprise me that he was told if he could hold out until the 9 hour mark, he’d just be allowed to walk.

Can’t remember which poster it was, but one stated here at LGF the same day of the incident that Miranda had made a big scene at Heathrow when they didn’t immediately hand back his passport. I’m not sure that was intentional on his part or something that Glenn was counting on by sending him on the mission into countries where he’s not fluent in the lingua franca.

Pratt agreed, saying, “I think part of that is what we’re seeing in Obamacare. This is going to be what you’re talking about several times over.”

“Partial victory” in the sense that the judge has ruled that the only real way the police can view whatever is found in the documents is in terms of terrorism, i.e. is there proof in them that Miranda is either a terrorist or assisting terrorists. Scotland Yard’s been going over the data and building a criminal case, but Miranda’s lawyers will argue that the data is harmless without proof of the intended user’s plans for it.

The last time I went to the ER, with insurance, it cost me something like $3500.

I fell and broke my ankle in 2004. Not having insurance, I stayed home and self-treated with ice packs and ace bandage. It was not until 3 years later, when I had an insurance plan, I had x-rays which discovered the old fracture.

I am disabled now because of that.

But the ruling also meant that data cannot be used for the purposes of criminal investigation - although the court had previously heard that the Met had launched a criminal investigation after analysing the seized data.

In other words, the court says “You can look at the documents and decide if they’re of a sensitive nature…you just can’t do anything about it.”

I am disabled now because of that.

Back to the issue at hand though, New Mexico has an interesting assortment of laws involved here. NM law prohibits public accommodations from discriminating against people based on their sexual orientation. The photographers don’t contest their public accommodation status under NMHRA. By refusing to photograph the commitment ceremony between two women, they violated the NMHRA but this does not violate the Free Speech or the Free Exercise Clause of the First Amendment to the United States Constitution.

The key is that NM has this NMHRA - NMSA 1978, §§ 28-1-1 to -13, which extends additional requirements for access to services that other states don’t have.

The photographer admitted that they were subject to the NMHRA, so that was the ballgame. If they’re providing photographic services to the public, they can’t discriminate against someone based on sexual orientation.

Texas Lt. Gov (and Rick Perry’s BFF) David Dewhurst tries to pull a “DO YOU KNOW WHO I AM” to get a relative out of a shoplifting arrest, fails.

“This is David Dewhurst, and I’m the lieutenant governor of the State of Texas,” he tells the dispatcher, who forwarded the call to a police department sergeant.

“What do I need to do to arrange for getting her out of jail this evening?” Dewhurst asks the police officer.

The officer explains that the case is now in the hands of Collin County authorities and there’s nothing he can do to expedite the woman’s release.

“I am, every year, the number-one pick of all of the law enforcement agencies within Texas,” Dewhurst tells the officer. “You don’t know it, but I’m a supporter of you and a supporter of law enforcement.”

Dewhurst repeatedly asks what he needs to do to get the woman out of jail, and is politely instructed by the Allen police officer to call the sheriff’s office.

“This is ridiculous,” Dewhurst says. “This lady, in my mind, is 100 percent innocent, and it’s just an unfortunate situation of circumstances.”

On several occasions, Dewhurst says the commander of the Texas Department of Public Safety will be calling to follow up on his inquiry.

“We don’t decide guilt or innocence,” the police sergeant calmly explains to the lieutenant governor, who then asked for the phone number of the sergeant’s supervisor and of the Collin County judge and sheriff. The sergeant declined both requests.

Allen Police Department spokesman Sgt. Jon Felty said every department policy was followed.

“Our procedure was followed to the letter, nothing was done that should not have been done. No favors granted, anything of that nature,” he said.

Felty also commended the officer who spoke with Dewhurst. “He handled it professionally. He knew who he was talking to, obviously, and he didn’t handle it any different than he would have for any other citizen for the state of Texas.”

When I came back to the dorm, after the party, the place reeked of partially digested cheap tequila. It wasn’t till a friend shared a glass of Cazadores Reposada that I was able to even think of drinking tequila.

Tequilla can be scary. Some girls I studied abroad with wanted to do shots one night. I politely turned that down. I don’t mind it in margaritas but I don’t llike tequilla at all on its own especially cheap.

I went to a city based college. We lived downtown and were for the most part dirt poor artist hippie kids having a blast being out on our own. There was a little market about four blocks from our dorm rooms. The nice thing about this carry out; they’d serve just about anyone above 14 years old and breathing with a wallet. Hey, no one was asking, and we were not telling. So, Friday evenings it would look like a line of ants going from the dorms to the market and back. Two kids to a case. I think even the cops knew what was going on, but in the early 70s no one was downtown anyway. The students owned the place after 7:00 PM.

If I remember, for $2.99 we’d get a case of 16 ounce bottles of Robin Hood Ale. Sure, it was crap local brewed ale, but 12 16 ouncers for kids on a budget. Shoot, after a couple of those babies no one cared what they tasted like.

Oh the stories. Today, almost none of what we pulled off could be done. That might be for the good, but we sure didn’t know it.

I certainly won’t give a blanket endorsement of the Guardian, but Spencer Ackerman’s national security - related writing has, on its own, been good. It’s worth noting that he’s not a fan of the kind of purity policing Greenwald & his fans so often do, so I think that at some point, the Guardian’s may have to decide which man it wants to keep, if either fellow doesn’t force the issue first.

For all I know, Miranda could’ve refused a lawyer until the last hour of his detention, but say he wasn’t OFFERED one til the last hour. Combined with the facts that he wasn’t allowed to write the questions and didn’t get a translator, that doesn’t give me comfort.

In turn, this leads me to a larger point: Greenwald & friends aren’t the only ones with dirt on themselves here.

The Guardian’s gotten things wrong, Snowden needs to face the music, and Cameron’s government-while right to question Miranda-held him way too long and peppered him with a number of questions that were way the eff out in left field.

I certainly won’t give a blanket endorsement of the Guardian, but Spencer Ackerman’s national security - related writing has, on its own, been good. It’s worth noting that he’s not a fan of the kind of purity policing Greenwald & his fans so often do, so I think that at some point, the Guardian’s may have to decide which man it wants to keep, if either fellow doesn’t force the issue first.

The Guardian’s gotten things wrong, Snowden needs to face the music, and Cameron’s government-while right to question Miranda-held him way too long and peppered him with a number of questions that were way the eff out in left field.

It’s possible to believe all these things at once.

It’s also possible to believe the Guardian is lying its ass off and the events of that 9hrs makes it look like the authorities had every reason to believe that Miranda was up to his eyeballs in something illegal.

I should also explain that the reason I am so antsy about relationships is that I want to be married before my Paternal Grandfather dies. He is paralyzed in a wheelchair. He is a very sweet old man, without any of the racism his son has. I want him at the wedding.

And it’s a relief to have a clean, fresh face all the time.

Women can “cross dress” as much as they wish, which I do, but it’s men who need to get a grip about all that.

Not sure what your point is. More than a couple of thousand were held for more than one hour. Do you know who any of them were?
I commented the other night that when I went to Scotland (via Glasgow Airport) back in 2004, I was told in no uncertain terms to NOT identify myself as a US journalist, even though that was and is my main occupation, because THAT fact alone was almost immediate grounds for denying me entry into the UK, even though I was not going to Scotland with my “journalist hat” on.
I was also told that when I went to England (via Manchester Airport) a few years later (again, not traveling wearing my “journalist hat”).
I still got grilled for some time at Glasgow when I identified myself as a farmer (my other job).
When I went to UK later, I identified myself as a housewife on holiday to visit friends in Yorkshire and THAT still took 30 minutes.

Fine. But check this: the UK made 63,902 of these “Schedule 7 stops” in 2011-12. 61,662 people stopped were held under an hour. With those kinds of numbers, you’d have to think someone was Zawahiri himself to hold him for 9.

How are we safer again?

You might feel better holding this until the British describe what they’re finding on Miranda’s media. They have a week, and seem to have results already.

My point is that there is a big enough gap between shorter stops (which, for all we know, could go anywhere from, say, 20 minutes to an hour) and longer ones that can go “the full nine” to suggest abuse on the part of the authorities.

I’m an American with British blood, and I’m old enough to remember a time when the British government used anti-terrorism laws to broadbrush Irish civilians. Of course, you’ll probably use your next post to say I don’t want any counterterrorism programs at all, but I’m not going to reflexively lie down with Cameron & Co. on this one, skip.

I’m an American with British blood, and I’m old enough to remember a time when the British government used anti-terrorism laws to broadbrush Irish civilians. Actually no, I was going to suggest you sit on your ass and wait until the full facts come out before speaking from atop your ivory tower about “abuse.” Though I’m sure you’ll be quick to declare that it doesn’t matter what Miranda did, 9 hours was totally uncalled for and he should have been turned loose the moment he refused to talk to the authorities.

Actually, the argument of many people on this thread seems to be: since the Guardian has stepped in shit, a proportional response is necessary, and the only appropriately proportional response is to not read any of the Guardian’s NatSec writers.

No, shorter me is that I have no clue what sort of man Miranda is and have every reason to believe that his version of events, as reported by the Guardian, are at best half-truths and worst total fabrications. I don’t start from the assumption that the government abused its power and then work back from there.

That’s what makes most Western countries stable democracies. When countries start rounding up ex-leaders once another party takes over it’s a very destabilizing factor on democracy. When leaders have to fear arrest and prosecution it makes them less likely to leave power voluntarily. That’s why democracy has a hard time taking hold in many parts of the world.

I just have a hard time squaring that with an American President whose attitude towards torture was “Just change the name and knock yourselves out, guys.”

You’d think that fear of being prosecuted for torturing other humans would be enough of a deterrent.
